The Real Estate Law Group also has considerable experience in the financing of
real estate, both from the borrower's and the lender's perspectives. When
representing a borrower, the Real Estate Law Group keeps the client's needs and
desires in mind and takes particular care to see that both the structure of the
transaction and the documentation are fair from the borrower's point of view. We
use this approach to negotiate the terms and documentation of a new loan or to
develop an acceptable workout plan for a problem loan.
We also represent financial institutions making commercial loans. It has become
incumbent upon lenders to ensure that loan transactions are carefully structured and
borrowers are carefully scrutinized before a loan is made. The Real Estate Law
Group assists lenders in structuring loans and in the choice and preparation of
documentation, beginning with the very important, but often underscrutinized, loan
commitment. Careful attention to the type and quality of collateral is essential in
protecting the lender's interests. We work closely with lenders to help assure
that each loan will prove to be of mutual benefit to both the lender and the borrower.
Not all projects (or borrowers) are successful. Where the borrower is not able to meet
the terms and conditions of the loan, we assist the lender in restructuring the loan in a
manner that is beneficial to both lender and borrower. We have the expertise to anticipate and
deal with potential insolvency and bankruptcy issues and can help design a satisfactory workout
that will return the loan to performing status.
